Sergio Ixtepan-Toto, 36, died on December 6, 2024 Pickens (South Carolina), He was driving drunk after nearly hitting another car on Zhenxi Street.
When a Pickens police officer attempted to pull Istepan-Toto over, he allegedly ran the stop sign and continued driving until he was pulled over by officers into the store parking lot.
During the stop, police reported that Istepan-Toto failed field sobriety tests and had multiple open beer cans in his vehicle.

An incident report also stated that he had a Mexican ID card, FOX Carolina reports.
Istepan-Toto was released on local charges and taken into custody by Immigration and Customs Enforcement agents on Dec. 9.

An affidavit filed by a deportation official on Dec. 12 said Istepan-Toto’s immigration file showed: he was deported May 2020, November 2022 and February 2024.

“There is no record that Istpan ever obtained permission from the U.S. Attorney General or his successor, the Secretary of Homeland Security, to reapply to INS or ICE for admission to the United States after being arrested and deported,” the affidavit states.
