The ongoing brand dispute between the Macrotech developers, directed by Abhishek LodhaAnd the house of Abhinandan Lodha (Hoabl), headed by Abhinandan Lodha, has intensified. Macrotech has accused Hoabl of committing fake and creating false documents to try to take advantage of the “Lodha” brand name.
In a recent regulatory outreach on the Bombay (BSE) and National Securities Stock Exchange (NSE) on April 2, Macrotech developers stated that the entities linked to Hoabl had used counterfeit board resolutions and a PAN card manufactured to get approval to change corporate names to include “Lodha”.
The company stated that this Board meeting did not take place and stated that the resolutions were not deliberate or endorsed by their counselors.
“No meeting of the company was held on the date on these BRS and the company’s council has not considered or approved these BRs in any of its meetings,” he added.
In response, Lodha Ventures, in a statement, said: “This refers to a presentation by Macrotech Developers Limited with the Stock Exchanges. We are studying the matter internally and we will return again with our detailed response. It is enough to say that the Abhinandan Lodha House does not support any of Fraud and forgiveness that should be declared.”
In January, the Macrotech developers initiated legal action against Hoabl in the High Court of Mumbai for brand violation. Demand seeks to relief, damage and other appropriate remedies.
Macrotech developers, recognized for selling properties under the “Lodha” brand, is a prominent actor in the real estate industry. On the other hand, Hoabl specializes in the development of residential plots in various large cities.
The alleged counterfeit resolutions contained a statement of “no objection” of Macrotech, falsely granting permission for the entities of Hoabl to use the trademark “Lodha”. It was also found that the signature of a director independent of these documents was forged, as confirmed by the director when he discovered that both the signature and a copy of his PAN card included in the application were fraudulent.
Allegedly, at least two companies associated with Hoabl modified their registered names to incorporate “Lodha” after the presentation of these forged documents.
In response to these complaints, the Board of Macrotech has formed a special committee of counselors for exhaustive investigation and pursuing a legal appeal. It is noteworthy that Abhishek Lodha has been excused from the Committee to ensure an impartial examination of the matter.
