Special counsel Jack Smith resigned from the Justice Department on Friday, Fox News has learned.
President-elect Trump’s resignation, which has been expected since he was elected in November, was quietly announced in a footnote in a court filing on Saturday.
“The Special Counsel completed his work and submitted his final confidential report on January 7, 2025, and resigned from the Department of Justice on January 10,” the note read.
Smith appointed by Attorney General Merrick Garland November 2022 Investigating the 2020 election interference case against Trump on January 6 and Mar-a-Lago Confidential document case. In 2017, Smith served as the acting U.S. attorney for the Middle District of Tennessee during the first Trump administration.

The news comes as the nation awaits the release of Smith’s report into the election interference case. A recent court filing shows Garland plans to release the investigative report soon, possibly before Trump takes office on January 20.
On Friday, a federal appeals court judge ruled against prevent release Smith’s report.
In a recent letter to me, Garland wrote: “As I have made clear to every special counsel I have served since I took office, I am committed to conducting as many of my duties as possible consistent with the requirements of the law and department policy. Unveiling the Special Counsel’s Report,” House Judiciary Committee Chairman Jim Jordan (R-Ohio) and Ranking Member Jamie Raskin (D-Md.).

“These cases, like every other case I have been forced to live through, are hollow and lawless and should never have been brought,” Trump said in a “Truth Society” post. “This is a political hijack, and it is ours. A low point in the nation’s history, something like this could have happened, but I persevered against all odds and won. “Make America Great Again!”
