New Civil Liberties Alliance, a conservative legal group, filed a lawsuit against Trump administration on Thursday to impose Rates to Chinese Imports.

Presented in a Florida Federal Court, the lawsuit claims that Trump did not have the legal authority to impose the rates that were presented on Wednesday, as well as the authorized functions on February 1 under the International Law of Economic Emergency Powers (IEEEPA).

NCLA’s leading lawyer, Andrew Morris, argued that Trump, imposing heavy rates on Chinese imports, had “misused” emergency powers, “used the Congress’s right to control rates and brought the separation of constitution powers.”

NCLA filed the demand in the name of Simpified, a retailer of home management products based in Florida.

Trump announced on Wednesday that China would be affected by a 34%rate, as well as 20%it imposed earlier this year, bringing the total number of new taxes to 54%.

Demand calls for a judge to block the implementation and application of rates and undo Trump changes to the United States Tarifari Calendar.

Demand says that presidents can only impose tariffs with the permission of the congress and in the complex trade statutes that explain how and when they can be authorized.

“These statutes require early research, detailed findings and a close adjustment between legal authority and the scope of the rate,” says the lawsuit.

Trump has declared an emergency about China’s alleged complicity in the United States opioid epidemic, which frames the rates as a negotiation tool to end the influx of fatal drugs.

Ncla said that his demand is “not bothered” with Trump’s statement on an emergency related to opioids “, but he has problems with his decision to impose tariffs in response, without legal authority to do so.”

The case was assigned to the Judge of the North -American District Kent Wethell, a Trump named who had stopped a key part of the previous President Joe Biden’s Immigration policy by 2023.
