Washington -If the American citizen of a 29-year-old man recognized by Trump’s administration wrongly deported El Salvador said he was afraid of his safety in the infamous mega-call Where they hold him, claiming that her husband is “amazing father” and “not a criminal.”
Kilmar Abrego Garcia was deported to El Salvador on March 15th and closed in the prison of the maximum security of that country known as Cecot, as part of a series of US Deportation Flights who lit a legal battle with high roles in US courts.
Trump’s administration has admit In the Federal Court that his deportation was an “administrative mistake”, since the referee of immigration in 2019 gave him legal protection from El Salvador. But it rejected the demands to return Abbrego Garcia, saying that now they no longer have custody of him. He also accuses him of being part of the MS-13, a transnational crime gang. Abrega lawyers Garcia said in court documents that their client did not have a criminal complaint, which is a finding that the government did not dispute.
During an exclusive interview with CBS News, Jennifer, wife of Abrega Garcia, she said she confirmed that her husband had been deported from the USA, closed in Cecot prison after identifying him in a photo posted by the Salvadorans Government.
“When I saw him, I immediately broke because I knew it was him,” she said. “I was afraid of his life.”
Jennifer, who asked her last name, said that she was “very scared” because of the transfer of Abrega Garcia to Cecot because there is one of the most dangerous members of the band El Salvador. After all, she said, the reason that the US immigration judge in 2019 approved the dismissal of deportation for concern that gangs in El Salvador could persecute him.
“I saw the news about that prison,” she said. “I know they take criminals there. And my husband is not a criminal.”
Abrego Garcia came to the United States in 2011, when he was 16 years old. According to court documents, he entered the country illegally without being inspected by immigration officials.
In 2019, Abrego Garcia was arrested by immigration and customs implementation after meeting with a local police outside Maryland Home Depot. Abrego Garcia lawyers said He went there looking for a job. He remained in his detention for months, while the immigration judge examined his case.
Court documents Showing an immigration judge initially refused to release Abrega Garcia to the bond, partly because of the information the government filed for whom she said he had been tied to MS-13. The court bond, supported by the Immigration Committee, mentioned the information of an informant for which the Government considered it credible.
However, Abrego Garcia was eventually released from custody after another immigration judge approved “denial of removal”, a legal classification that forbids officials to deport individuals who prove that they are more likely to not face persecution in their home country. In his order, the judge said that Abrego Garcia could target gangs if they were sent to El Salvador.
Jennifer said her husband attended regular reports with ICE after being released. He became the main feeder of their family, she added and helped her raise their five -year -old son with disabilities, as well as two children from the previous relationship. He worked five days a week as a Lima worker, while he also attended college classes, she said.
On March 12, however, Abrega Garcia again arrested Ice. Jennifer said she was driving with their five -year -old son with disabilities when they stopped him. She said she hurried to the location, and Ice officers told her that her husband’s status had “changed” and that he would be printed with her finger and detained.
Over the next few days, Jennifer said her husband had been transferred to various immigration detention centers, including those in Louisiani and Texas. During her latest phone call, Jennifer said that Abrego Garcia told her she would be deported to El Salvador and closed to Cecot.
Jennifer said she couldn’t believe it. She told her husband that there was no reason to send him to the side of prison now. He said that if he did not receive another call from him, that would be because he was deported.
“He never called,” Jennifer said. “I waited and waited. He never made that call.”
Jennifer said she hadn’t been heard from her husband from that call and did not find a way to communicate with him. She’s now sues the government As part of the lawsuit before the federal district Maryland court It is demanding for the US government to take steps to bring Abrego Garcia back to the country.
Although he admitted that he was wrongly deported to Abrego Garcia, Trump’s administration defended his deportations and told the Federal Court in Maryland to oppose his return to the United States
The Ministry of Justice has argumentative These federal courts do not have the authority to facilitate the return of Abrega Garcia, because it is now held by the Salvadorane Government and is no longer in US custody. Even if they had the power to order his return, the Ministry of Justice said, in the application “showed that El Salvador was even inclined to consider the request for release at the request of the United States.”
Trump officials, including the press secretary of the Karolina Leavitt White House, described Abrego Garcia as the “leader” of the MS-13 who was involved in the trade of humans. Officials have not yet discovered concrete evidence that supports these claims.
Jennifer had strongly rejected the White House accusations, saying she would know if her husband would be a member of the gang. Court documents say that Abrego Garcia has traffic offenses, but there is no criminal charges or verdict in the United States
“He’s not a criminal,” Jennifer said. “My husband is an amazing person. Amazing father.”
