
President Donald Trump’s administration has asked the Supreme Court to block a lower court ruling, demanding that a man who was deported back to El Salvador return to the United States.

The government said Mr. Garcia was deported on March 15 due to “administrative errors,” although they also insisted that he was a member of the MS-13 gang, which his family denied.
In an urgent appeal to the U.S. Supreme Court, the government argued that a Maryland judge lacked the power to issue orders and that U.S. officials could not force El Salvador to return to Mr. Garcia.
“The United States does not control El Salvador’s sovereign states, nor can it force El Salvador to follow the bidding of federal judges,” U.S. Deputy Attorney General D John Sauer wrote in court documents.
He added: “The Constitution accuses the President, rather than the Federal District Court, of conducting foreign diplomatic actions and protecting the state from foreign terrorists, including by removing him from dismissal.”
Mr. Garcia was illegal in the United States, despite a judge granting protection from deportation in 2019.
